1. Agreement to Terms

By accessing or using Conversati ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Conversati is a conversational CRM platform with workflow automation and document intelligence features. The Service includes:

  • Contact and company relationship management
  • Deal pipeline tracking
  • Activity and task management
  • Conversational AI interface
  • Document upload, search, and question answering
  • Workflow automation capabilities
  • Email and communication processing

3. User Accounts

Account Creation

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

Age Requirement

You must be at least 18 years old to use this Service. By using the Service, you represent that you are at least 18 years of age.

4. Acceptable Use

Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms.

Prohibited Activities

You agree not to:

5. User Content

Your Content

You retain ownership of all content you submit to the Service, including:

  • Documents and files
  • Conversation history
  • Notes and activities

License to Us

By submitting content, you grant us a limited license to:

  • Store and process your content to provide the Service
  • Use AI models to generate insights and responses
  • Create embeddings and search indexes of your documents
  • Display your content back to you and authorized users

We do not use your content for marketing or to train our models for other users.

Content Responsibility

You are solely responsible for your content and the consequences of posting it. You represent that you have all necessary rights to your content and that it does not violate any third-party rights.

6. Beta Testing

Conversati is currently in beta testing. During this period:

  • The Service is provided free of charge
  • Features may change without notice
  • Availability and uptime are not guaranteed
  • We may request feedback on your experience
  • You acknowledge that the Service may contain bugs or errors
  • We reserve the right to modify or discontinue features

7. Fees and Payment

The Service is currently free during beta. When we transition to paid plans:

  • We will provide 30 days notice before charging
  • Pricing will start at $19 per user per month
  • Beta users may receive promotional pricing
  • Payment will be processed through Stripe
  • Subscriptions auto-renew unless canceled
  • Refunds may be provided at our discretion

8. Intellectual Property

Our Property

The Service and its original content, features, and functionality are owned by Conversati and are protected by international copyright, trademark, and other intellectual property laws.

Trademarks

"Conversati" and our logo are trademarks of Conversati, Inc. You may not use these marks without our prior written permission.

9. Third-Party Services

The Service may integrate with third-party services including:

  • Supabase (database and authentication)
  • OpenAI (AI features and embeddings)
  • Stripe (payment processing)

Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability or accuracy of third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability or fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or availability
  • Error-free or uninterrupted operation
  • Security of data transmission

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONVERSATI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Conversati and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • At your request
  • Discontinuation of the Service

Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the settings page.

14. Data Backup and Export

While we implement regular backups, you are responsible for maintaining your own backups of your data. We provide data export features to help you download your content at any time.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or through the Service. Your continued use after changes constitutes acceptance of the modified Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court to protect intellectual property rights.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Conversati regarding the Service and supersede all prior agreements.
